민사소송법 제453조(재심관할법원)

①재심은 재심을 제기할 판결을 한 법원의 전속관할로 한다.

②심급을 달리하는 법원이 같은 사건에 대하여 내린 판결에 대한 재심의 소는 상급법원이 관할한다. 다만, 항소심판결과 상고심판결에 각각 독립된 재심사유가 있는 때에는 그러하지 아니하다.
