민사집행법 제264조(부동산에 대한 경매신청)

①부동산을 목적으로 하는 담보권을 실행하기 위한 경매신청을 함에는 담보권이 있다는 것을 증명하는 서류를 내야 한다.

③부동산 소유자에게 경매개시결정을 송달할 때에는 제2항의 규정에 따라 제출된 서류의 등본을 붙여야 한다.
