①방송사업자 및 중계방송권자등은 제76조제3항의 규정에 따른 일반국민의 보편적 시청권을 보장하기 위하여 다음 각 호의 어느 하나에 해당하는 행위(이하 이 조에서 "금지행위"라 한다)를 하거나 제3자로 하여금 이를 하도록 하여서는 아니 된다. <개정 2016.1.27>

1. 중계방송권자등으로서 국민 전체가구 중 대통령령으로 정하는 비율 이상의 가구가 국민관심행사등을 시청할 수 있는 방송수단(이하 "보편적 방송수단"이라 한다)을 확보하지 아니하는 행위

②방송미디어통신위원회는 금지행위를 하였거나 제3자로 하여금 이를 하도록 한 방송사업자 및 중계방송권자등에 대하여 금지행위의 중지 등 필요한 시정조치를 명할 수 있다. 이 경우 방송미디어통신위원회는 시정조치를 명하기 전에 당사자에게 기간을 정하여 의견진술의 기회를 주어야 한다. 다만, 당사자가 정당한 사유 없이 이에 응하지 아니하는 때에는 그러하지 아니한다. <개정 2008.2.29, 2016.1.27, 2025.10.1>

③방송미디어통신위원회는 금지행위를 하였거나 제3자로 하여금 이를 하도록 하였는지에 대한 사실관계의 조사를 위하여 필요한 경우 대통령령으로 정하는 바에 따라 방송사업자 및 중계방송권자등에게 자료제출을 요청할 수 있고, 소속 공무원으로 하여금 방송사업자 및 중계방송권자등의 사무소 또는 사업장에 출입하여 조사를 하게 할 수 있다. <개정 2008.2.29, 2013.3.23, 2016.1.27, 2020.6.9, 2025.10.1>

④방송미디어통신위원회는 방송사업자 및 중계방송권자등이 정당한 사유 없이 제2항의 규정에 따른 시정조치를 이행하지 아니하는 때에는 해당 중계방송권의 총계약금액에 100분의 5를 곱한 금액을 초과하지 아니하는 범위 안에서 과징금을 부과할 수 있다. <개정 2008.2.29, 2019.12.10, 2025.10.1>
