Enforcement Decree of the Act on Report on Real Estate Transactions, etc., Article 21 (Standards, etc. for Reduction or Waiver for Voluntary Reporters)

① 법 제29조에 따른 과태료의 감경 또는 면제 기준은 다음 각 호와 같다. <개정 2020.2.18, 2021.5.31>

1. 법 제6조제1항 또는 제3항(각각 법 제6조의4제3항에서 준용하는 경우를 포함한다)에 따른 국토교통부장관 또는 신고관청(이하 "조사기관"이라 한다)의 조사가 시작되기 전에 자진 신고한 자로서 다음 각 목의 요건을 모두 충족한 경우: 과태료 면제

1. 가. 자진 신고한 위반행위가 법 제28조제2항제2호ㆍ제3호 또는 같은 조 제3항부터 제5항까지의 어느 하나에 해당할 것

(a)어 The^ð더 violation^v바이얼레이션 voluntarily^v발런테^r럴리 reported^r리포티드 falls^f폴즈 under언더 any에니 of어^v브 Article아터클 28 (2) 2 or오 3, or오 paragraphs패^r러그^r래^f프스 (3) through^θ쓰^r루 (5) of어^v브 the^ð더 same세임 Article,아터클 of어^v브 the^ð디 Act;액트

나. 신고관청에 단독(거래당사자 일방이 여러 명인 경우 그 일부 또는 전부가 공동으로 신고한 경우를 포함한다. 이하 이 조에서 같다)으로 신고한 최초의 자일 것

다. 위반사실 입증에 필요한 자료 등을 제공하는 등 조사가 끝날 때까지 성실하게 협조하였을 것

(c)시 The^ð더 person퍼슨 cooperated코아퍼^r레이티드 faithfully^f페이^θ스^f펄리 until언틸 the^ð디 investigation인^v베스터게이션 ended,엔디드 such서치 as애즈 by바이 providing프^r러^v바이딩 the^ð더 materials머티^r리얼즈 needed니디드 to투 prove프^r루^v브 the^ð더 violation;^v바이얼레이션

2. 조사기관의 조사가 시작된 후 자진 신고한 자로서 다음 각 목의 요건을 모두 충족한 경우: 과태료의 100분의 50 감경

가. 제1호가목 및 다목에 해당할 것

나. 조사기관이 허위신고 사실 입증에 필요한 증거를 충분히 확보하지 못한 상태에서 조사에 협조했을 것

(b)비 The^ð더 person퍼슨 cooperated코아퍼^r레이티드 with위^ð드 the^ð디 investigation인^v베스터게이션 while와일 the^ð디 investigating인^v베스터게이팅 agency에이전시 had해드 not낫 yet옛 secured시큐어드 sufficient서^f피션트 evidence에^v버든스 to투 prove프^r루^v브 the^ð더 false^f폴스 report;^r리포트

다. 조사기관에 단독으로 신고한 최초의 자일 것

(c)시 The^ð더 person퍼슨 is이즈 the^ð더 first^f퍼스트 to투 report^r리포트 to투 the^ð디 investigating인^v베스터게이팅 agency에이전시 alone.얼론

② 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 과태료를 감경ㆍ면제하지 않는다. <개정 2020.2.18>

1. 자진 신고하려는 부동산등의 거래계약과 관련하여 「국세기본법」 또는 「지방세법」 등 관련 법령을 위반한 사실 등이 관계기관으로부터 조사기관에 통보된 경우

2. 자진 신고한 날부터 과거 1년 이내에 제1항제1호 및 제2호에 따른 자진 신고를 하여 3회 이상 해당 신고관청에서 과태료의 감경 또는 면제를 받은 경우

③ 법 제29조에 따라 자진 신고를 하려는 자는 국토교통부령으로 정하는 신고서 및 위반행위를 입증할 수 있는 서류를 조사기관에 제출해야 한다. <개정 2020.2.18>

④ 제1항부터 제3항까지에서 규정한 사항 외에 자진 신고자에 대한 과태료의 감경 또는 면제에 대한 세부운영절차 등은 국토교통부령으로 정한다.
