성폭력범죄의 처벌 등에 관한 특례법 제43조(신상정보의 제출 의무)

① 등록대상자는 제42조제1항의 판결이 확정된 날부터 30일 이내에 다음 각 호의 신상정보(이하 "기본신상정보"라 한다)를 자신의 주소지를 관할하는 경찰관서의 장(이하 "관할경찰관서의 장"이라 한다)에게 제출하여야 한다. 다만, 등록대상자가 교정시설 또는 치료감호시설에 수용된 경우에는 그 교정시설등의 장에게 기본신상정보를 제출함으로써 이를 갈음할 수 있다. <개정 2014.12.30, 2016.12.20, 2024.1.16>

② 관할경찰관서의 장 또는 교정시설등의 장은 제1항에 따라 등록대상자가 기본신상정보를 제출할 때에 등록대상자의 정면ㆍ좌측ㆍ우측 상반신 및 전신 컬러사진을 촬영하여 전자기록으로 저장ㆍ보관하여야 한다. <개정 2016.12.20>

③ 등록대상자는 제1항에 따라 제출한 기본신상정보가 변경된 경우에는 그 사유와 변경내용(이하 "변경정보"라 한다)을 변경사유가 발생한 날부터 20일 이내에 제1항에 따라 제출하여야 한다. <개정 2016.12.20>

④ 등록대상자는 제1항에 따라 기본신상정보를 제출한 경우에는 그 다음 해부터 매년 12월 31일까지 주소지를 관할하는 경찰관서에 출석하여 경찰관서의 장으로 하여금 자신의 정면ㆍ좌측ㆍ우측 상반신 및 전신 컬러사진을 촬영하여 전자기록으로 저장ㆍ보관하도록 하여야 한다. 다만, 교정시설등의 장은 등록대상자가 교정시설 등에 수용된 경우에는 석방 또는 치료감호 종료 전에 등록대상자의 정면ㆍ좌측ㆍ우측 상반신 및 전신 컬러사진을 새로 촬영하여 전자기록으로 저장ㆍ보관하여야 한다. <개정 2016.12.20>

⑤ 관할경찰관서의 장 또는 교정시설등의 장은 등록대상자로부터 제출받은 기본신상정보 및 변경정보와 제2항 및 제4항에 따라 저장ㆍ보관하는 전자기록을 지체 없이 법무부장관에게 송달하여야 한다. <개정 2016.12.20>

⑥ 제5항에 따라 등록대상자에 대한 기본신상정보를 송달할 때에 관할경찰관서의 장은 등록대상자에 대한 「형의 실효 등에 관한 법률」 제2조제5호에 따른 범죄경력자료를 함께 송달하여야 한다. <개정 2016.12.20>

⑦ 기본신상정보 및 변경정보의 송달, 등록에 관한 절차와 방법 등 필요한 사항은 대통령령으로 정한다. <개정 2016.12.20>
