여객자동차 운수사업법 제15조(여객자동차운송사업의 상속)

① 운송사업자가 사망한 경우 상속인이 그 여객자동차운송사업을 계속하려면 피상속인이 사망한 날부터 90일 이내에 국토교통부장관 또는 시ㆍ도지사에게 신고하여야 한다. 다만, 제4항 단서에 따라 운송사업자가 사망하여 상속인이 그 여객자동차운송사업을 계속하려는 경우에 대한 상속 신고기간은 사업구역별로 사업면허의 수요ㆍ공급 등을 고려하여 피상속인이 사망한 날부터 90일 이상 180일 이하의 범위에서 관할 지방자치단체의 조례로 달리 정할 수 있다. <개정 2009.5.27, 2013.3.23, 2015.6.22, 2025.12.2>

② 국토교통부장관 또는 시ㆍ도지사는 제1항에 따른 신고를 받은 날부터 국토교통부령으로 정하는 기간 내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2017.3.21>

③ 국토교통부장관 또는 시ㆍ도지사가 제2항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장 여부를 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2017.3.21>

④ 제1항에도 불구하고 대통령령으로 정하는 운송사업자가 사망한 경우에는 상속인이 그 여객자동차운송사업을 계속할 수 없다. 다만, 사업구역별로 사업면허의 수요ㆍ공급 등을 고려하여 관할 지방자치단체의 조례로 달리 정하는 경우에는 그러하지 아니하다. <신설 2015.6.22, 2017.3.21>

⑤ 상속인이 제1항에 따른 신고를 한 경우 피상속인이 사망한 날부터 신고를 한 날까지의 기간 동안 피상속인에 대한 여객자동차운송사업의 면허나 등록은 상속인에 대한 면허나 등록으로 본다. <개정 2015.6.22, 2017.3.21>

⑥ 제1항에 따라 신고를 한 상속인은 피상속인이 지니고 있던 운송사업자로서의 지위를 승계한다. <개정 2015.6.22, 2017.3.21>

⑦ 제1항에 따른 신고를 한 자의 결격사유에 관하여는 제6조를 준용한다. 다만, 피상속인이 사망한 날부터 90일(제1항 단서에 따라 조례로 정하는 경우에는 그 기간을 말한다) 이내에 상속인이 그 여객자동차운송사업을 다른 사람에게 양도한 경우에는 피상속인의 사망일부터 양도일까지의 기간 동안 피상속인에 대한 여객자동차운송사업의 면허나 등록은 상속인에 대한 면허나 등록으로 본다. <개정 2015.6.22, 2017.3.21, 2025.12.2>
