의료급여법 제12조(요양비)

① 시장ㆍ군수ㆍ구청장은 수급권자가 보건복지부령으로 정하는 긴급하거나 그 밖의 부득이한 사유로 의료급여기관과 같은 기능을 수행하는 기관으로서 보건복지부령으로 정하는 기관(제28조제1항에 따라 업무정지기간 중인 의료급여기관을 포함한다)에서 질병ㆍ부상ㆍ출산 등에 대하여 의료급여를 받거나 의료급여기관이 아닌 장소에서 출산을 하였을 때에는 그 의료급여에 상당하는 금액을 보건복지부령으로 정하는 바에 따라 수급권자에게 요양비로 지급한다.

② 제1항에 따라 의료급여를 실시한 기관은 보건복지부장관이 정하는 요양비명세서 또는 요양의 명세를 적은 영수증을 요양을 받은 사람에게 내주어야 하며, 요양을 받은 사람은 이를 시장ㆍ군수ㆍ구청장에게 제출하여야 한다.

③ 제1항에 따른 요양비의 지급방법 등에 필요한 사항은 보건복지부령으로 정한다.
