의료급여법 제30조(이의신청 등)

① 수급권자의 자격, 의료급여 및 급여비용에 대한 시장ㆍ군수ㆍ구청장의 처분에 이의가 있는 자는 시장ㆍ군수ㆍ구청장에게 이의신청을 할 수 있다.

② 급여비용의 심사ㆍ조정, 의료급여의 적정성 평가 및 급여 대상 여부의 확인에 관한 급여비용심사기관의 처분에 이의가 있는 제5조에 따른 보장기관, 의료급여기관 또는 수급권자는 급여비용심사기관에 이의신청을 할 수 있다. <개정 2017.3.21>

③ 제1항 및 제2항에 따른 이의신청은 처분이 있음을 안 날부터 90일 이내에 문서(전자문서를 포함한다)로 하여야 하며, 처분이 있은 날부터 180일이 지나면 제기하지 못한다. 다만, 정당한 사유에 따라 그 기간에 이의신청을 할 수 없었음을 소명한 경우에는 그러하지 아니하다.

④ 제3항 본문에도 불구하고 의료급여기관이 제11조의3에 따른 급여비용심사기관의 확인에 대하여 이의신청을 하려면 같은 조 제2항에 따라 통보받은 날부터 30일 이내에 하여야 한다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 이의신청의 방법, 이의신청에 대한 결정 및 결정의 통지 등에 필요한 사항은 대통령령으로 정한다.
