자동차관리법 제30조의8(핵심장치등의 안전성인증 절차 등)

① 안전성인증을 받으려는 자는 자동차 또는 부품의 제작등을 한 때에(자동차의 경우 제30조에 따른 자동차자기인증을 하기 전을 말한다) 국토교통부령으로 정하는 바에 따라 자동차안전기준등 적합여부에 대한 시험(이하 "안전성능시험"이라 한다)을 국토교통부장관에게 신청하여야 한다. 이 경우 국토교통부장관은 핵심장치등이 자동차안전기준등에 적합하게 제작등이 되었다고 인정하는 경우 안전성인증서를 교부하여야 한다.

② 국토교통부장관은 제1항에 따른 신청을 받은 때에는 성능시험대행자로 하여금 해당 핵심장치등의 안전성능시험을 대행하게 할 수 있다.

③ 제2항에 따른 성능시험대행자의 안전성능시험은 다음 각 호의 어느 하나에 해당하는 안전성능시험으로 갈음할 수 있다. 이 경우 성능시험대행자는 안전성능시험시설이 제7항에 따른 안전성능시험시설 기준에 적합한지 확인하여야 하고, 필요한 경우에는 같은 항에 따른 안전성능시험 확인의 기준에 따라 안전성능시험을 확인할 수 있다.

④ 국토교통부장관은 자동차 및 부품제작자등이 안전성인증을 받은 핵심장치등을 안전성인증 후에도 자동차안전기준등에 적합하게 제작등을 하는지 검사(이하 "적합성검사"라 한다)할 수 있다. 이 경우 국토교통부장관은 적합성검사를 성능시험대행자로 하여금 대행하게 할 수 있다.

⑤ 국토교통부장관은 제4항에 따른 적합성검사 결과 안전성인증을 받은 핵심장치등이 자동차안전기준등에 적합하지 아니하게 제작등을 하는 것으로 확인되는 경우 자동차 및 부품제작자등에게 시정조치를 명할 수 있다.

⑥ 국토교통부장관은 성능시험대행자에게 제2항 및 제4항에 따라 안전성능시험 및 적합성검사에 관한 업무를 대행하게 하는 경우 그에 필요한 시설, 장비 및 인증 등에 필요한 비용을 지원하여야 한다.

⑦ 제1항 및 제4항에 따른 핵심장치등의 안전성인증, 안전성능시험 및 적합성검사의 방법ㆍ절차, 제2항 및 제4항에 따른 안전성능시험 및 적합성검사의 대행, 제3항에 따른 시험기관의 지정, 안전성능시험시설 및 안전성능시험 확인의 기준ㆍ절차, 그 밖에 필요한 사항은 국토교통부령으로 정한다.
