자본시장과 금융투자업에 관한 법률 제309조(예탁결제원에의 예탁 등)

① 예탁결제원에 증권등을 예탁하고자 하는 자는 예탁결제원에 계좌를 개설하여야 한다.

② 제1항에 따라 계좌를 개설한 자(이하 "예탁자"라 한다)는 자기가 소유하고 있는 증권등과 투자자로부터 예탁받은 증권등을 투자자의 동의를 얻어 예탁결제원에 예탁할 수 있다.

③ 예탁결제원은 다음 각 호의 사항을 기재하여 예탁자계좌부를 작성ㆍ비치하되, 예탁자의 자기소유분과 투자자 예탁분이 구분될 수 있도록 하여야 한다. <개정 2008.2.29>

④ 예탁결제원은 예탁증권등을 종류ㆍ종목별로 혼합하여 보관할 수 있다.

⑤ 예탁자 또는 그 투자자가 증권등을 인수 또는 청약하거나, 그 밖의 사유로 새로 증권등의 발행을 청구하는 경우에 그 증권등의 발행인은 예탁자 또는 그 투자자의 신청에 의하여 이들을 갈음하여 예탁결제원을 명의인으로 하여 그 증권등을 발행할 수 있다. <개정 2016.3.22>
