자본시장과 금융투자업에 관한 법률 제409조(거래소가 발행한 증권의 상장 및 상장폐지의 승인)

① 거래소는 자기가 발행한 증권을 상장하거나 상장을 폐지하고자 하는 경우에는 금융위원회의 승인을 받아야 한다. <개정 2008.2.29>

② 거래소는 제1항에 따라 상장한 경우에는 이상거래의 심리, 회원의 감리, 수시공시, 그 밖의 상장관리 등을 자체적으로 수행하고 그 결과를 금융위원회에 보고하여야 한다. <개정 2008.2.29>
