Financial Investment Services and Capital Markets Act, Article 429-3 (Penalty Surcharges for Illegal Short Selling)

① 금융위원회는 제180조를 위반하여 상장증권에 대하여 허용되지 아니하는 방법으로 공매도를 하거나 공매도 주문을 위탁 또는 수탁한 자에 대하여 다음 각 호의 구분에 따른 위반금액을 초과하지 아니하는 범위에서 과징금을 부과할 수 있다.

② 금융위원회는 제180조의4를 위반한 자에 대하여 5억원 이하의 과징금을 부과할 수 있다. 다만, 그 위반행위와 관련된 거래로 얻은 이익(미실현 이익을 포함한다. 이하 이 항에서 같다) 또는 이로 인하여 회피한 손실액의 1.5배에 해당하는 금액이 5억원을 초과하는 경우에는 그 이익 또는 회피한 손실액의 1.5배에 상당하는 금액 이하의 과징금을 부과할 수 있다.

③ 금융위원회는 제1항에 따른 과징금을 부과할 때 동일한 위반행위로 제443조제1항제10호에 따라 벌금을 부과받은 경우에는 과징금 부과를 취소하거나 벌금에 상당하는 금액의 전부 또는 일부를 과징금에서 제외할 수 있다.
