재난 및 안전관리 기본법 제41조(위험구역의 설정)

① 시장ㆍ군수ㆍ구청장과 지역통제단장(대통령령으로 정하는 권한을 행사하는 경우에만 해당한다. 이하 이 조에서 같다)은 재난이 발생하거나 발생할 우려가 있는 경우에 사람의 생명 또는 신체에 대한 위해 방지나 질서의 유지를 위하여 필요하면 위험구역을 설정하고, 응급조치에 종사하지 아니하는 사람에게 다음 각 호의 조치를 명할 수 있다.

② 시장ㆍ군수ㆍ구청장과 지역통제단장은 제1항에 따라 위험구역을 설정할 때에는 그 구역의 범위와 제1항제1호에 따라 금지되거나 제한되는 행위의 내용, 그 밖에 필요한 사항을 보기 쉬운 곳에 게시하여야 한다.

③ 관계 중앙행정기관의 장은 재난이 발생하거나 발생할 우려가 있는 경우로서 사람의 생명 또는 신체에 대한 위해 방지나 질서의 유지를 위하여 필요하다고 인정되는 경우에는 시장ㆍ군수ㆍ구청장과 지역통제단장에게 위험구역의 설정을 요청할 수 있다. <신설 2013.8.6>
