재난 및 안전관리 기본법 제76조의3(재난안전의무보험의 평가 및 개선권고 등)

① 행정안전부장관은 재난안전의무보험에 관한 법령과 재난안전의무보험의 관리ㆍ운용 등이 제76조의2제1항에 따른 기준에 적합한지 등을 분석ㆍ평가하기 위하여 필요한 경우에는 재난안전의무보험 관련 법령을 주관하거나 재난안전의무보험의 운용을 주관하는 중앙행정기관의 장 등에게 관련 자료의 제출을 요청할 수 있다. 이 경우 자료의 제출을 요청받은 중앙행정기관의 장 등은 특별한 사유가 없으면 이에 따라야 한다.

② 행정안전부장관은 제1항에 따른 재난안전의무보험 등의 분석ㆍ평가 결과 해당 재난안전의무보험 등이 제76조의2제1항에 따른 기준에 적합하지 아니하다고 인정하는 경우에는 재난안전의무보험 관련 법령을 주관하거나 재난안전의무보험의 운용을 주관하는 중앙행정기관의 장 등에게 관련 법령의 개정권고, 재난안전의무보험의 관리ㆍ운용에 대한 개선권고 등을 할 수 있다.

③ 행정안전부장관은 제2항에 따른 관련 법령의 개정권고 및 재난안전의무보험의 관리ㆍ운용에 대한 개선권고에 관한 사항이 효과적으로 추진될 수 있도록 재난안전의무보험에 관한 법령을 주관하는 중앙행정기관의 장으로부터 재난안전의무보험 제도개선에 관한 계획을 제출받아 이를 종합한 정비계획(이하 "정비계획"이라 한다)을 수립할 수 있다.
