Enforcement Decree of the Copyright Act, Article 67-4 (Exclusion, Challenge, and Recusal of Review Committee Members)

① 심의위원회의 위원이 다음 각 호의 어느 하나에 해당하는 경우에는 위원회의 심의ㆍ의결에서 제척된다.

(1) A어 member멤버 of어^v브 the^ð더 Review^r리^v뷰 Committee커미티 shall섈 be비 excluded익스클루디드 from^f프^r럼 the^ð더 deliberation딜리버^r레이션 and앤드 resolution^r레절루션 of어^v브 the^ð더 Committee커미티 in인 any에니 of어^v브 the^ð더 following^f팔로잉 cases:케이시즈

1. 위원 또는 그 배우자나 배우자였던 사람이 해당 안건의 당사자(당사자가 법인ㆍ단체 등인 경우에는 그 임원을 포함한다. 이하 이 호 및 제2호에서 같다)가 되거나 그 안건의 당사자와 공동권리자 또는 공동의무자인 경우

1. Where웨어 the^ð더 member,멤버 or오 the^ð더 member's멤버즈 spouse스파우스 or오 former^f포머 spouse,스파우스 is이즈 a어 party파티 to투 the^ð더 matter매터 concerned컨선드 (including,인클루딩 where웨어 the^ð더 party파티 is이즈 a어 corporation,코퍼^r레이션 organization,오거너제이션 etc.,엣세터^r러 its잇츠 officers;오^f퍼서즈 the^ð더 same세임 applies어플라이즈 hereinafter히^r리내^f프터 in인 this^ð디스 subparagraph서브패^r러그^r래^f프 and앤드 subparagraph서브패^r러그^r래^f프 2), or오 is이즈 a어 joint조인트 right^r라잇 holder호울더 or오 joint조인트 obligor어블리거 with위^ð드 a어 party파티 to투 the^ð더 matter;매터

2. 위원이 해당 안건의 당사자와 친족이거나 친족이었던 경우

3. 위원이 해당 안건에 대하여 증언, 진술, 자문, 연구, 용역 또는 감정을 한 경우

4. 위원이나 위원이 속한 법인ㆍ단체 등이 해당 안건의 당사자의 대리인이거나 대리인이었던 경우

5. 위원이 해당 안건의 당사자의 임원 또는 직원으로 재직하고 있거나 재직하였던 경우

6. 위원이 해당 안건의 원인이 된 처분이나 부작위에 관여하고 있거나 관여하였던 경우

② 해당 안건의 당사자는 심의위원회의 위원에게 공정한 심의ㆍ의결을 기대하기 어려운 사정이 있는 경우에는 심의위원회에 기피 신청을 할 수 있고, 심의위원회는 의결로 이를 결정한다. 이 경우 기피 신청의 대상인 위원은 그 의결에 참여하지 못한다.

③ 심의위원회의 위원이 제1항 각 호에 따른 제척 사유에 해당하는 경우에는 스스로 해당 안건의 심의ㆍ의결에서 회피하여야 한다.
