Enforcement Decree of the Copyright Act, Article 72-3 (Procedures and Methods for Account Suspension Orders)

① 심의위원회가 법 제133조의2제2항에 따라 심의를 하는 때에는 다음 각 호의 사항을 고려하여야 한다. <개정 2016.9.21>

② 문화체육관광부장관은 법 제133조의2제2항에 따라 온라인서비스제공자에게 해당 불법복제물등의 복제ㆍ전송자의 계정을 정지할 것을 명하려면 다음 각 호의 사항을 기재한 명령서를 작성하여 서면으로 통지하여야 한다.

2. 법 제133조의2제1항제1호에 따른 경고를 3회 이상 받은 사실

③ 법 제133조의2제2항에 따른 복제ㆍ전송자의 계정 정지 기간은 다음 각 호와 같다.

1. 첫 번째 정지하는 경우 1개월 미만

④ 제2항의 명령서를 받은 온라인서비스제공자는 지체 없이 법 제133조의2제3항에 따라 해당 복제ㆍ전송자에게 제2항 각 호의 사항을 기재하여 서면으로 통지하여야 한다.
