지방세법 시행령 제116조의4(향교 및 종교단체에 대한 재산세 특례 대상 및 신청 등)

① 법 제119조의3제1항에서 "대통령령으로 정하는 개별 향교 또는 개별 종교단체"란 「부동산 실권리자명의 등기에 관한 법률 시행령」 제5조제1항제3호에 따른 개별 향교 또는 같은 항 제2호에 따른 소속종교단체를 말한다.

③ 법 제119조의3제2항에 따라 토지에 대한 재산세를 개별단체별로 합산하여 납부할 것을 신청하려는 자는 행정안전부령으로 정하는 토지분 재산세 합산배제 신청서에 다음 각 호의 서류를 첨부하여 법 제115조에 따른 납기개시 20일 전까지 해당 토지의 소재지를 관할하는 지방자치단체의 장에게 제출해야 한다.

④ 제3항에 따른 신청을 받은 지방자치단체의 장은 개별단체별 합산 여부를 결정하여, 신청한 내용이 사실과 다를 경우 세액이 추징될 수 있다는 내용과 함께 그 결과를 서면으로 통지해야 한다. 이 경우 상대방이 전자적 통지를 요청할 경우에는 전자적 방법으로 통지할 수 있다.

⑤ 제3항에 따른 신청을 하여 토지에 대한 재산세를 개별단체별로 합산하여 납부한 경우에는 다음 연도부터 해당 토지의 소유관계가 변동하기 전까지는 제3항의 신청을 다시 하지 않아도 된다.
