지방자치법 제130조(자문기관의 설치 등)

① 지방자치단체는 소관 사무의 범위에서 법령이나 그 지방자치단체의 조례로 정하는 바에 따라 자문기관(소관 사무에 대한 자문에 응하거나 협의, 심의 등을 목적으로 하는 심의회, 위원회 등을 말한다. 이하 같다)을 설치ㆍ운영할 수 있다.

② 자문기관은 법령이나 조례에 규정된 기능과 권한을 넘어서 주민의 권리를 제한하거나 의무를 부과하는 내용으로 자문 또는 심의 등을 하여서는 아니 된다.

③ 자문기관의 설치 요건ㆍ절차, 구성 및 운영 등에 관한 사항은 대통령령으로 정한다. 다만, 다른 법령에서 지방자치단체에 둘 수 있는 자문기관의 설치 요건ㆍ절차, 구성 및 운영 등을 따로 정한 경우에는 그 법령에서 정하는 바에 따른다.

④ 지방자치단체는 자문기관 운영의 효율성 향상을 위하여 해당 지방자치단체에 설치된 다른 자문기관과 성격ㆍ기능이 중복되는 자문기관을 설치ㆍ운영해서는 아니 되며, 지방자치단체의 조례로 정하는 바에 따라 성격과 기능이 유사한 다른 자문기관의 기능을 포함하여 운영할 수 있다.

⑤ 지방자치단체의 장은 자문기관 운영의 효율성 향상을 위한 자문기관 정비계획 및 조치 결과 등을 종합하여 작성한 자문기관 운영현황을 매년 해당 지방의회에 보고하여야 한다.
