집합건물의 소유 및 관리에 관한 법률 제59조(소관청의 직권조사)

① 소관청은 제56조 또는 제57조의 신청을 받아 또는 직권으로 건축물대장에 등록할 때에는 소속 공무원에게 건물의 표시에 관한 사항을 조사하게 할 수 있다.

② 소관청은 구분점포에 관하여 제56조 또는 제57조의 신청을 받으면 신청 내용이 제1조의2제1항 각 호의 요건을 충족하는지와 건축물의 실제 현황과 일치하는지를 조사하여야 한다.

③ 제1항 및 제2항의 조사를 하는 경우 해당 공무원은 일출 후 일몰 전까지 그 건물에 출입할 수 있으며, 점유자나 그 밖의 이해관계인에게 질문하거나 문서의 제시를 요구할 수 있다. 이 경우 관계인에게 그 신분을 증명하는 증표를 보여주어야 한다.
