채무자 회생 및 파산에 관한 법률 제388조(파산과 특정유증)

①파산선고 전에 채무자를 위하여 특정유증이 있는 경우 채무자가 파산선고 당시 승인 또는 포기를 하지 아니한 때에는 파산관재인이 채무자에 갈음하여 그 승인 또는 포기를 할 수 있다.

②「민법」 제1077조(유증의무자의 최고권)의 규정은 제1항의 경우에 관하여 준용 한다.
