출입국관리법 제81조(출입국관리공무원 등의 외국인 동향조사)

① 출입국관리공무원과 대통령령으로 정하는 관계 기관 소속 공무원은 외국인이 이 법 또는 이 법에 따른 명령에 따라 적법하게 체류하고 있는지와 제46조제1항 각 호의 어느 하나에 해당되는지를 조사하기 위하여 다음 각 호의 어느 하나에 해당하는 자를 방문하여 질문하거나 그 밖에 필요한 자료를 제출할 것을 요구할 수 있다. <개정 2020.2.4>

② 출입국관리공무원은 허위초청 등에 의한 외국인의 불법입국을 방지하기 위하여 필요하면 외국인의 초청이나 국제결혼 등을 알선ㆍ중개하는 자 또는 그 업소를 방문하여 질문하거나 자료를 제출할 것을 요구할 수 있다.

③ 출입국관리공무원은 거동이나 주위의 사정을 합리적으로 판단하여 이 법을 위반하였다고 의심할 만한 상당한 이유가 있는 외국인에게 정지를 요청하고 질문할 수 있다.

④ 제1항이나 제2항에 따라 질문을 받거나 자료 제출을 요구받은 자는 정당한 이유 없이 거부하여서는 아니 된다.
