특허법 제28조의2(고유번호의 기재)

① 특허에 관한 절차를 밟는 자 중 총리령으로 정하는 자는 지식재산처장 또는 특허심판원장에게 자신의 고유번호의 부여를 신청하여야 한다. <개정 2025.10.1>

② 지식재산처장 또는 특허심판원장은 제1항에 따른 신청을 받으면 신청인에게 고유번호를 부여하고, 그 사실을 알려야 한다. <개정 2025.10.1>

(2) Upon어판 receipt^r리싯 of어^v브 an앤 application애플러케이션 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 Minister미너스터 of어^v브 Intellectual인털렉추얼 Property프^r라퍼티 or오 the^ð더 President프^r레저덴트 of어^v브 the^ð디 Intellectual인털렉추얼 Property프^r라퍼티 Trial트^r라이얼 and앤드 Appeal어필 Board보드 shall섈 assign어사인 an앤 identification아이덴터^f퍼케이션 number넘버 to투 the^ð디 applicant애플리컨트 and앤드 notify노우터^f파이 the^ð디 applicant애플리컨트 of어^v브 that^ð댓 fact.^f팩트

③ 지식재산처장 또는 특허심판원장은 특허에 관한 절차를 밟는 자가 제1항에 따라 고유번호를 신청하지 아니하면 그에게 직권으로 고유번호를 부여하고, 그 사실을 알려야 한다. <개정 2025.10.1>

④ 제2항 또는 제3항에 따라 고유번호를 부여받은 자가 특허에 관한 절차를 밟는 경우에는 총리령으로 정하는 서류에 자신의 고유번호를 적어야 한다. 이 경우 이 법 또는 이 법에 따른 명령에도 불구하고 그 서류에 주소(법인인 경우에는 영업소의 소재지를 말한다)를 적지 아니할 수 있다. <개정 2025.10.1>

⑤ 특허에 관한 절차를 밟는 자의 대리인에 관하여는 제1항부터 제4항까지의 규정을 준용한다.
