하도급거래 공정화에 관한 법률 제23조(조사대상 거래의 제한)

①제22조제2항에 따라 공정거래위원회의 조사개시 대상이 되는 하도급거래(제13조제11항이 적용되는 거래를 포함한다. 이하 이 조에서 같다)는 그 거래가 끝난 날부터 3년(제12조의3을 위반하는 경우에는 그 거래가 끝난 날부터 7년으로 한다. 이하 이 조에서 같다)이 지나지 아니한 것으로 한정한다. 다만, 거래가 끝난 날부터 3년 이내에 제22조제1항 전단에 따라 신고되거나 제24조의4제1항제1호 또는 제2호의 분쟁당사자가 분쟁조정을 신청한 하도급거래의 경우에는 거래가 끝난 날부터 3년이 지난 경우에도 조사를 개시할 수 있다. <개정 2010.1.25, 2015.7.24, 2018.1.16, 2018.4.17>

② 제1항에서 "거래가 끝난 날"이란 제조위탁ㆍ수리위탁 및 용역위탁 중 지식ㆍ정보성과물의 작성위탁의 경우에는 수급사업자가 원사업자에게 위탁받은 목적물을 납품 또는 인도한 날을, 용역위탁 중 역무의 공급위탁의 경우에는 원사업자가 수급사업자에게 위탁한 역무공급을 완료한 날을 말하며, 건설위탁의 경우에는 원사업자가 수급사업자에게 건설위탁한 공사가 완공된 날을 말한다. 다만, 하도급계약이 중도에 해지되거나 하도급거래가 중지된 경우에는 해지 또는 중지된 날을 말한다. <신설 2010.1.25>
