① 소비자는 다음 각 호의 기간(거래당사자가 그 보다 긴 기간을 약정한 경우에는 그 기간을 말한다) 이내에 할부계약에 관한 청약을 철회할 수 있다.

1. 제6조제1항에 따른 계약서를 받은 날부터 7일. 다만, 그 계약서를 받은 날보다 재화등의 공급이 늦게 이루어진 경우에는 재화등을 공급받은 날부터 7일

가. 제6조제1항에 따른 계약서를 받지 아니한 경우

나. 할부거래업자의 주소 등이 적혀 있지 아니한 계약서를 받은 경우

다. 할부거래업자의 주소 변경 등의 사유로 제1호의 기간 이내에 청약을 철회할 수 없는 경우

② 소비자는 다음 각 호의 어느 하나에 해당하는 경우에는 제1항에 따른 청약의 철회를 할 수 없다. 다만, 할부거래업자가 청약의 철회를 승낙하거나 제6항에 따른 조치를 하지 아니한 경우에는 제2호부터 제4호까지에 해당하는 경우에도 청약을 철회할 수 있다.

1. 소비자에게 책임있는 사유로 재화등이 멸실되거나 훼손된 경우. 다만, 재화등의 내용을 확인하기 위하여 포장 등을 훼손한 경우는 제외한다.

③ 소비자가 제1항에 따라 청약을 철회할 경우 제1항에 따른 기간 이내에 할부거래업자에게 청약을 철회하는 의사표시가 적힌 서면을 발송하여야 한다.

④ 제1항에 따른 청약의 철회는 제3항에 따라 서면을 발송한 날에 그 효력이 발생한다.

⑤ 제1항 또는 제2항을 적용함에 있어서 계약서의 발급사실과 그 시기, 재화등의 공급 사실과 그 시기 및 제2항 각 호 중 어느 하나에 해당하는지 여부에 관하여 다툼이 있는 경우에는 할부거래업자가 이를 입증하여야 한다.

⑥ 할부거래업자는 제2항제2호부터 제4호까지의 규정에 따라 청약을 철회할 수 없는 재화등에 대하여는 그 사실을 재화등의 포장이나 그 밖에 소비자가 쉽게 알 수 있는 곳에 분명하게 표시하거나 시용(試用) 상품을 제공하는 등의 방법으로 소비자가 청약을 철회하는 것이 방해받지 아니하도록 조치하여야 한다.
