행정기본법 제27조(공법상 계약의 체결)

① 행정청은 법령등을 위반하지 아니하는 범위에서 행정목적을 달성하기 위하여 필요한 경우에는 공법상 법률관계에 관한 계약(이하 "공법상 계약"이라 한다)을 체결할 수 있다. 이 경우 계약의 목적 및 내용을 명확하게 적은 계약서를 작성하여야 한다.

② 행정청은 공법상 계약의 상대방을 선정하고 계약 내용을 정할 때 공법상 계약의 공공성과 제3자의 이해관계를 고려하여야 한다.
