행정기본법 제6조(행정에 관한 기간의 계산)

① 행정에 관한 기간의 계산에 관하여는 이 법 또는 다른 법령등에 특별한 규정이 있는 경우를 제외하고는 「민법」을 준용한다.

② 법령등 또는 처분에서 국민의 권익을 제한하거나 의무를 부과하는 경우 권익이 제한되거나 의무가 지속되는 기간의 계산은 다음 각 호의 기준에 따른다. 다만, 다음 각 호의 기준에 따르는 것이 국민에게 불리한 경우에는 그러하지 아니하다.
