가족관계의 등록 등에 관한 법률 제49조(항해 중의 출생)

① 항해 중에 출생이 있는 때에는 선장은 24시간 이내에 제44조제2항에서 정한 사항을 항해일지에 기재하고 서명 또는 기명날인하여야 한다.

② 제1항의 절차를 밟은 후 선박이 대한민국의 항구에 도착하였을 때에는 선장은 지체 없이 출생에 관한 항해일지의 등본을 그 곳의 시ㆍ읍ㆍ면의 장 또는 재외국민 가족관계등록사무소의 가족관계등록관에게 발송하여야 한다. <개정 2015.2.3>

③ 선박이 외국의 항구에 도착하였을 때에는 선장은 지체 없이 제2항의 등본을 그 지역을 관할하는 재외공관의 장에게 발송하고 재외공관의 장은 지체 없이 외교부장관을 경유하여 재외국민 가족관계등록사무소의 가족관계등록관에게 발송하여야 한다. <개정 2013.3.23, 2015.2.3>

④ 제3항에 따른 서류의 송부는 대법원규칙으로 정하는 바에 따라 전산정보처리조직을 이용하여 할 수 있다. 이 경우 해당 서류 원본의 보존, 그 밖에 필요한 사항은 대법원규칙으로 정한다. <신설 2015.2.3>
