Enforcement Decree of the Building Act, Article 9-3 (Exceptions to Securing Ownership When Applying for a Building Permit)

① 법 제11조제11항제2호에서 "건축물의 노후화 또는 구조안전 문제 등 대통령령으로 정하는 사유"란 건축물이 다음 각 호의 어느 하나에 해당하는 경우를 말한다.

② 허가권자는 건축주가 제1항제1호부터 제3호까지의 어느 하나에 해당하는 사유로 법 제11조제11항제2호의 동의요건을 갖추어 같은 조 제1항에 따른 건축허가를 신청한 경우에는 그 사유 해당 여부를 확인하기 위하여 현지조사를 하여야 한다. 이 경우 필요한 경우에는 건축주에게 다음 각 호의 어느 하나에 해당하는 자로부터 안전진단을 받고 그 결과를 제출하도록 할 수 있다. <개정 2018.1.16>
