게임산업진흥에 관한 법률 제22조(등급분류 거부 및 통지 등)

①위원회는 제16조제2항제1호부터 제4호까지의 규정에 따른 업무의 수행을 위하여 필요한 경우에는 등급분류를 신청한 자에게 등급심사에 필요한 자료의 제출을 요구할 수 있다. <개정 2011.4.5, 2013.5.22>

②위원회는 「사행행위 등 규제 및 처벌특례법」, 「형법」 등 다른 법률의 규정 또는 이 법에 의하여 규제 또는 처벌대상이 되는 행위 또는 기기에 대하여 등급분류를 신청한 자, 정당한 권원을 갖추지 아니하였거나 거짓이나 그 밖의 부정한 방법으로 등급분류를 신청한 자 또는 사행성게임물에 해당되는 게임물에 대하여 등급분류를 신청한 자에 대하여 등급분류를 거부할 수 있다. <개정 2007.1.19, 2013.5.22, 2023.8.8>

③위원회는 등급분류 결정을 한 경우에는 다음 각 호의 서류를 신청인에게 교부하고, 사행성게임물에 해당되어 등급분류를 거부결정한 경우에는 결정의 내용 및 그 이유를 기재한 서류를 지체 없이 신청인에게 교부하여야 한다. <개정 2007.1.19, 2013.5.22, 2018.12.11>

④위원회는 등급분류를 받은 게임물이 제2항의 규정에 따른 등급분류 거부 대상인 사실을 알게 된 때에는 지체 없이 등급분류 결정을 취소하여야 한다. <개정 2007.1.19, 2013.5.22>

⑤제1항부터 제3항까지에 따른 자료제출요구의 기준ㆍ절차ㆍ방법, 등급분류 결정, 등급분류 거부결정 및 사행성게임물 결정의 절차, 등급분류증명서의 교부와 게임물내용정보에 포함될 사항 등에 관하여 필요한 사항은 문화체육관광부령으로 정한다. <개정 2008.2.29, 2018.12.11, 2023.8.8>
