경범죄 처벌법 제9조(통고처분 불이행자 등의 처리)

① 경찰서장, 해양경찰서장 및 제주특별자치도지사는 다음 각 호의 어느 하나에 해당하는 사람에 대하여는 지체 없이 즉결심판을 청구하여야 한다. 다만, 즉결심판이 청구되기 전까지 통고받은 범칙금에 그 금액의 100분의 50을 더한 금액을 납부한 사람에 대하여는 그러하지 아니하다. <개정 2014.11.19, 2016.1.22, 2017.7.26>

② 제1항제2호에 따라 즉결심판이 청구된 피고인이 통고받은 범칙금에 그 금액의 100분의 50을 더한 금액을 납부하고 그 증명서류를 즉결심판 선고 전까지 제출하였을 때에는 경찰서장, 해양경찰서장 및 제주특별자치도지사는 그 피고인에 대한 즉결심판 청구를 취소하여야 한다. <개정 2014.11.19, 2016.1.22, 2017.7.26>

③ 제1항 단서 또는 제2항에 따라 범칙금을 납부한 사람은 그 범칙행위에 대하여 다시 처벌받지 아니한다.

④ 철도특별사법경찰대장은 제1항 각 호의 어느 하나에 해당하는 사람이 있는 경우에는 즉시 관할 경찰서장 또는 해양경찰서장에게 그 사실을 통보하고 관련 서류를 넘겨야 한다. 이 경우 통보를 받은 경찰서장 또는 해양경찰서장은 제1항부터 제3항까지의 규정에 따라 이를 처리하여야 한다. <개정 2014.11.19, 2016.1.22, 2017.7.26>
