경찰관 직무집행법 제10조(경찰장비의 사용 등)

① 경찰관은 직무수행 중 경찰장비를 사용할 수 있다. 다만, 사람의 생명이나 신체에 위해를 끼칠 수 있는 경찰장비(이하 이 조에서 "위해성 경찰장비"라 한다)를 사용할 때에는 필요한 안전교육과 안전검사를 받은 후 사용하여야 한다.

② 제1항 본문에서 "경찰장비"란 무기, 경찰장구(警察裝具), 경찰착용기록장치, 최루제(催淚劑)와 그 발사장치, 살수차, 감식기구(鑑識機具), 해안 감시기구, 통신기기, 차량ㆍ선박ㆍ항공기 등 경찰이 직무를 수행할 때 필요한 장치와 기구를 말한다. <개정 2024.1.30>

③ 경찰관은 경찰장비를 함부로 개조하거나 경찰장비에 임의의 장비를 부착하여 일반적인 사용법과 달리 사용함으로써 다른 사람의 생명ㆍ신체에 위해를 끼쳐서는 아니 된다.

④ 위해성 경찰장비는 필요한 최소한도에서 사용하여야 한다.

⑤ 경찰청장은 위해성 경찰장비를 새로 도입하려는 경우에는 대통령령으로 정하는 바에 따라 안전성 검사를 실시하여 그 안전성 검사의 결과보고서를 국회 소관 상임위원회에 제출하여야 한다. 이 경우 안전성 검사에는 외부 전문가를 참여시켜야 한다.

⑥ 위해성 경찰장비의 종류 및 그 사용기준, 안전교육ㆍ안전검사의 기준 등은 대통령령으로 정한다.
