Enforcement Decree of the Employment Insurance Act, Article 60-2 (Calculation of the Insured Unit Period)

(1) Where the insured unit period of an insured worker falling under Article 41 (3) of the Act satisfies the following formula, the worker shall be deemed to meet the requirement for the insured unit period under Article 40 (1), subparagraph 1 of the Act: [Formula] 1 ≤ insured unit period as a worker (in days) ÷ 180 days + insured unit period as an artist (in months) ÷ 9 months + insured unit period as a labor provider (in months) ÷ 12 months
② 법 제41조제3항에 해당하는 근로자인 피보험자가 다음 각 호에 해당하는 경우에는 해당 호에 따라 제1항의 계산식을 산정한다. <개정 2023.6.27>
(2) Where an insured worker falling under Article 41 (3) of the Act falls under any of the following, the formula under paragraph (1) shall be calculated in accordance with that subparagraph:
1. 법 제40조제2항에 따른 기준기간 동안에 근로자, 예술인 및 노무제공자로 동시에 보험에 가입된 경우: 근로자로서의 피보험 단위기간에만 포함하여 산정
1. Where the person was covered by insurance at the same time as a worker, an artist and a labor provider during the base period under Article 40 (2) of the Act: the period shall be counted only in the insured unit period as a worker;
2. 법 제40조제2항에 따른 기준기간 동안에 예술인 및 노무제공자로 동시에 보험에 가입된 경우: 예술인 또는 노무제공자의 피보험 단위기간 중 근로자인 피보험자에게 유리한 피보험 단위기간에만 포함하여 산정
2. Where the person was covered by insurance at the same time as an artist and a labor provider during the base period under Article 40 (2) of the Act: the period shall be counted only in whichever of the insured unit periods as an artist or as a labor provider is more favorable to the insured worker.
