공공주택 특별법 시행령 제42조(금융정보 등의 제공에 따른 동의서 제출 대상자 등)
Enforcement Decree of the Special Act on Public Housing, Article 42 (Persons Required to Submit Consent Forms for Provision of Financial Information, etc.)
① 법 제48조의4제1항 각 호 외의 부분에서 "대통령령으로 정하는 자"란 다음 각 호의 사람을 말한다. <개정 2022.12.29>
(1) The term "persons prescribed by Presidential Decree" in the part preceding the subparagraphs of Article 48-4 (1) of the Act means the following persons:
1. 신청자의 직계존속 및 신청자의 배우자의 직계존속으로서 신청자 또는 신청자의 배우자와 같은 세대별 주민등록표에 등재되어 있는 사람
1. The lineal ascendants of the applicant and the lineal ascendants of the applicant's spouse who are registered on the same household resident registration record as the applicant or the applicant's spouse;
2. 신청자의 직계비속 및 그 직계비속의 배우자로서 신청자 또는 신청자의 배우자와 같은 세대별 주민등록표에 등재되어 있는 사람

② 법 제48조의4제1항에 따른 자료 또는 정보의 구체적인 내용은 다음 각 호와 같다.
(2) The specific content of the data or information under Article 48-4 (1) of the Act is as follows:
1. 법 제48조의4제1항제1호에 따른 금융정보
1. Financial information under Article 48-4 (1) 1 of the Act:
가. 보통예금, 저축예금, 자유저축예금 등 요구불예금: 최근 3개월 이내의 평균 잔액
(a) Demand deposits such as ordinary deposits, savings deposits, and free savings deposits: the average balance over the most recent three months;
나. 정기예금, 정기적금, 정기저축 등 저축성예금: 잔액 또는 총납입금
(b) Savings-type deposits such as time deposits, installment savings, and regular savings: the balance or total amount paid in;
다. 주식, 수익증권, 출자금, 출자지분: 최종 시세가액. 이 경우 비상장주식의 평가에 관하여는 「상속세 및 증여세법 시행령」 제54조제1항을 준용한다.
(c) Stocks, beneficiary certificates, capital contributions, and equity interests: the latest market value. In this case, the valuation of unlisted stocks shall apply mutatis mutandis Article 54 (1) of the Enforcement Decree of the Inheritance Tax and Gift Tax Act;
라. 채권, 어음, 수표, 채무증서, 신주인수권 증서: 액면가액
(d) Bonds, notes, checks, debt instruments, and warrants: face value;
마. 연금저축: 정기적으로 지급된 금액 또는 최종 잔액
(e) Pension savings: the amount paid regularly or the final balance;
2. 법 제48조의4제1항제2호에 따른 신용정보
2. Credit information under Article 48-4 (1) 2 of the Act:
가. 대출 현황 및 연체 내용
(a) The status of loans and details of overdue payments;
나. 신용카드 미결제 금액
(b) Unsettled credit card amounts;
3. 법 제48조의4제1항제3호에 따른 보험정보
3. Insurance information under Article 48-4 (1) 3 of the Act:
가. 보험증권: 해약하는 경우 지급받게 될 환급금 또는 최근 1년 이내에 지급된 보험금
(a) Insurance policies: the refund that would be paid upon cancellation or insurance benefits paid within the most recent year;
나. 연금보험: 해약하는 경우 지급받게 될 환급금 또는 정기적으로 지급되는 금액
(b) Annuity insurance: the refund that would be paid upon cancellation or the amount paid regularly.
③ 법 제48조의4제1항에 따라 공공주택의 공급을 신청(재계약을 체결하는 경우를 포함한다. 이하 같다)하는 자는 국토교통부령으로 정하는 금융정보 등의 제공 동의서면을 국토교통부장관에게 직접 제출하거나 우편ㆍ팩스 또는 정보통신망에 의하여 제출할 수 있다.
(3) A person who applies for supply of public housing under Article 48-4 (1) of the Act (including a person who concludes a renewal contract; the same applies hereinafter) may submit the written consent to provision of financial information, etc. prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport to the Minister of Land, Infrastructure and Transport directly or by mail, fax, or information and communications network.
