공무원연금법 제47조(분할연금과 퇴직연금 등과의 관계)

① 제45조제1항에 따른 분할연금 수급권은 그 수급권을 취득한 후에 배우자였던 사람에게 생긴 사유로 퇴직연금 또는 조기퇴직연금의 수급권이 소멸ㆍ정지되어도 영향을 받지 아니한다. 다만, 형벌 등에 따른 사유로 배우자였던 사람의 퇴직연금액 또는 조기퇴직연금액이 감액되거나 지급이 정지된 경우에는 제65조를 준용한다.

② 수급권자에게 둘 이상의 분할연금 수급권이 생기면 둘 이상의 분할연금액을 합하여 지급한다.

③ 분할연금 수급권자는 제54조에 따른 퇴직유족연금을 지급할 때 퇴직연금 또는 조기퇴직연금 수급권자로 보지 아니한다.

④ 분할연금 수급권자에게 퇴직연금 또는 조기퇴직연금 수급권이 발생한 경우에는 분할연금액과 퇴직연금액 또는 조기퇴직연금액을 합하여 지급한다.

⑤ 분할연금 수급권이 소멸된 경우에는 그 사유가 발생한 날이 속하는 달의 다음 달부터 배우자였던 사람에게 분할되기 전의 금액을 지급한다.

⑥ 분할연금 수급권자와 그 배우자였던 사람이 모두 퇴직연금 또는 조기퇴직연금 수급권자인 경우에는 당사자들의 합의에 따라 각각의 분할연금을 지급하지 아니할 수 있다.
