공소청법 제30조(감찰담당 검사의 임용에 관한 특례)

① 공소청에 감찰에 관한 사무를 담당하는 검사(이하 "감찰담당 검사"라 한다)를 두며, 공소청 및 각급 공소청 내부 또는 외부를 대상으로 공개모집 절차를 통하여 적격자를 임용한다.

② 감찰담당 검사는 제28조 각 호의 직 또는 사무에 10년 이상 재직 또는 종사한 사람 중에서 임용한다.

③ 제42조에 따른 검사인사위원회는 제1항에 따라 공개모집에 응모한 사람이 임용 적격자인지를 심의하고, 3명 이내의 임용후보자를 선발하여 법무부장관에게 추천한다.

④ 제3항의 추천을 받은 법무부장관은 검찰총장의 의견을 들어 제42조에 따른 검사인사위원회가 추천한 임용후보자 중 1명을 대통령에게 임용 제청한다. 이 경우 임용 당시 검사인 사람은 전보의 방법으로 임용을 제청하고, 임용 당시 검사가 아닌 사람은 신규 임용의 방법으로 임용을 제청한다.

(4) Upon어판 receiving^r러시^v빙 the^ð더 recommendation^r레커먼데이션 under언더 paragraph패^r러그^r래^f프 (3), the^ð더 Minister미너스터 of어^v브 Justice저스티스 shall,섈 after애^f프터 hearing히^r링 the^ð디 opinion어피니언 of어^v브 the^ð더 Prosecutor프^r라시큐터 General,제너^r럴 propose프^r러포우즈 to투 the^ð더 President프^r레저덴트 one원 of어^v브 the^ð더 candidates캔더데잇츠 recommended^r레커멘디드 by바이 the^ð더 Prosecutors프^r라시큐터즈 Personnel퍼서넬 Committee커미티 under언더 Article아터클 42 for^f포 appointment.어포인트먼트 In인 this^ð디스 case,케이스 a어 person퍼슨 who후 is이즈 a어 prosecutor프^r라시큐터 at앳 the^ð더 time타임 of어^v브 appointment어포인트먼트 shall섈 be비 proposed프^r러포우즈드 for^f포 appointment어포인트먼트 by바이 way웨이 of어^v브 transfer,트^r랜스^f퍼 and앤드 a어 person퍼슨 who후 is이즈 not낫 a어 prosecutor프^r라시큐터 at앳 the^ð더 time타임 of어^v브 appointment어포인트먼트 shall섈 be비 proposed프^r러포우즈드 for^f포 appointment어포인트먼트 by바이 way웨이 of어^v브 new누 appointment.어포인트먼트

⑤ 감찰담당 검사의 임기는 2년으로 하며, 연임할 수 없다.

⑥ 임기가 끝난 감찰담당 검사는 후임자가 임용될 때까지 계속 그 직무를 수행한다.
