공익신고자 보호법 시행령 제16조(보호조치결정 등)

① 위원회는 법 제17조제1항에 따라 보호조치 신청을 받은 경우에는 그 신청을 접수한 날부터 60일 이내에 법 제20조제1항에 따른 보호조치결정 및 같은 조 제2항에 따른 보호조치 권고(이하 "보호조치결정등"이라 한다)를 하여야 한다. 다만, 필요한 경우에는 그 기간을 30일 이내에서 연장할 수 있다.

② 위원회는 보호조치결정등에 따라 불이익조치를 받은 공익신고자등에 대한 보호조치가 이루어질 수 있도록 불이익조치를 한 자가 소속된 기관의 장 등에게 불이익조치를 한 자에 대한 지도ㆍ감독 등 필요한 조치를 할 것을 권고할 수 있다.

③ 위원회는 보호조치결정등에 따른 보호조치를 하기가 어렵다고 인정되는 특별한 사정이 있는 경우에는 전직(轉職) 등 보호조치에 상응하는 조치를 할 것을 공익신고자등이 소속된 기관의 장 등에게 권고할 수 있다.

④ 위원회는 제2항 또는 제3항에 따른 권고 사실을 보호조치를 신청한 자에게 통지하여야 한다.

(4) The^ð더 Commission커미션 shall섈 notify노우터^f파이 the^ð더 person퍼슨 who후 applied어플라이드 for^f포 protective프^r러텍티^v브 measures메저즈 of어^v브 the^ð더 recommendation^r레커먼데이션 under언더 paragraph패^r러그^r래^f프 (2) or오 (3).
