Enforcement Decree of the Public Interest Whistleblower Protection Act, Article 25-3 (Standards for Payment of Rewards, etc.)

① 법 제26조의3제1항에 따른 포상금(이하 "포상금"이라 한다)은 다음 각 호의 구분에 따른 사항을 고려하여 차등 지급한다. 이 경우 지급한도액은 5억원으로 한다. <개정 2021.10.19, 2023.12.19, 2024.7.30>

② 포상금은 다음 각 호의 사유를 고려하여 포상금 지급액을 감액하거나 지급하지 아니할 수 있으며, 공익침해행위의 조사ㆍ수사업무에 종사 중이거나 종사하였던 공직자가 그 조사 또는 수사 사항과 관련하여 신고한 경우에는 포상금을 지급하지 아니한다.

③ 위원회는 법 제26조의3제1항에 따라 공익신고등으로 인하여 같은 항 각 호의 어느 하나에 해당하는 사유로 현저히 공공기관에 재산상 이익을 가져오거나 손실을 방지한 자 또는 공익의 증진을 가져온 자 중에서 법 제6조제1호부터 제3호까지 및 제5조에 해당하는 자 또는 기관으로부터 추천을 받거나 위원회의 직권으로 포상금 지급대상자를 선정한다. <개정 2023.6.13, 2024.7.30>

④ 위원회는 제3항에 따라 포상금 지급대상자를 선정하는 경우 보상심의위원회가 심의ㆍ의결한 사항을 기초로 포상금 지급 여부 및 지급금액을 결정하고, 포상금 지급결정이 있는 경우에는 결정서 정본 및 결정통지서를 포상금 지급대상자에게 지체 없이 보내야 한다.
