공익신고자 보호법 제19조(보호조치 신청에 대한 조사)

① 위원회는 보호조치를 신청받은 때에는 바로 공익신고자등이 공익신고등을 이유로 불이익조치를 받았는지에 대한 조사를 시작하여야 한다. 이 경우 위원회는 공익신고자등이 보호조치를 신청한 사실을 조사기관에 통보할 수 있다.

② 위원회는 보호조치의 신청에 대한 조사에 필요하다고 인정하면 다음 각 호의 어느 하나에 해당하는 자에게 관련 자료의 제출을 요구할 수 있다. <개정 2021.4.20>

③ 위원회는 제2항제1호부터 제3호까지의 자에게 출석을 요구하여 진술을 청취하거나 진술서의 제출을 요구할 수 있다.

④ 위원회는 조사 과정에서 관계 당사자에게 충분한 소명(疏明) 기회를 주어야 한다.

⑤ 위원회는 제1항 후단에 따라 공익신고자등이 보호조치를 신청한 사실을 조사기관에 통보하면서 공익침해행위 조사와 관련된 자료의 제출 등의 협조를 요청할 수 있다. 이 경우 조사기관은 정당한 사유가 없으면 이에 협조하여야 한다. <개정 2017.10.31>
