①사회단체 등은 선거부정을 감시하는 등 공명선거추진활동을 할 수 있다. 다만, 다음 각 호의 어느 하나에 해당하는 단체는 그 명의 또는 그 대표의 명의로 공명선거추진활동을 할 수 없다. <개정 2000.2.16, 2002.3.7, 2004.3.12, 2005.8.4>

1. 특별법에 의하여 설립된 국민운동단체로서 국가 또는 지방자치단체의 출연 또는 보조를 받는 단체(바르게살기운동협의회ㆍ새마을운동협의회ㆍ한국자유총연맹을 말한다)

②사회단체 등이 공명선거추진활동을 함에 있어서는 항상 공정한 자세를 견지하여야 하며, 특정 정당이나 후보자의 선거운동에 이르지 아니하도록 유의하여야 한다.

③각급선거관리위원회(읍ㆍ면ㆍ동선거관리위원회를 제외한다)는 사회단체 등이 불공정한 활동을 하는 때에는 경고ㆍ중지 또는 시정명령을 하여야 하며, 그 행위가 선거운동에 이르거나 선거관리위원회의 중지 또는 시정명령을 이행하지 아니하는 때에는 고발 등 필요한 조치를 하여야 한다. <개정 2005.8.4>
