공직선거법 제11조(후보자 등의 신분보장)

①대통령선거의 후보자는 후보자의 등록이 끝난 때부터 개표종료시까지 사형ㆍ무기 또는 장기 7년 이상의 징역이나 금고에 해당하는 죄를 범한 경우를 제외하고는 현행범인이 아니면 체포 또는 구속되지 아니하며, 병역소집의 유예를 받는다. <개정 1995.5.10>

③ 선거사무장ㆍ선거연락소장ㆍ선거사무원ㆍ회계책임자ㆍ투표참관인ㆍ사전투표참관인과 개표참관인(예비후보자가 선임한 선거사무장ㆍ선거사무원 및 회계책임자는 제외한다)은 해당 신분을 취득한 때부터 개표종료시까지 사형ㆍ무기 또는 장기 3년 이상의 징역이나 금고에 해당하는 죄를 범하였거나 제230조부터 제235조까지 및 제237조부터 제259조까지의 죄를 범한 경우를 제외하고는 현행범인이 아니면 체포 또는 구속되지 아니하며, 병역소집의 유예를 받는다. <개정 2011.7.28, 2014.1.17>
