공직선거법 제218조의24(재외투표의 개표)

① 재외투표는 구ㆍ시ㆍ군선거관리위원회가 개표한다.

② 재외투표함은 개표참관인의 참관 아래 선거일 오후 6시(대통령의 궐위로 인한 선거 또는 재선거는 오후 8시를 말한다. 이하 이 조에서 같다) 후에 개표소로 옮겨서 다른 투표함의 투표지와 별도로 먼저 개표할 수 있다. <개정 2011.7.28>

③ 제1항에도 불구하고 중앙선거관리위원회는 천재지변 또는 전쟁ㆍ폭동, 그 밖에 부득이한 사유로 재외투표가 선거일 오후 6시까지 관할 구ㆍ시ㆍ군선거관리위원회에 도착할 수 없다고 인정하는 때에는 해당 재외선거관리위원회로 하여금 재외투표를 보관하였다가 개표하게 할 수 있다. <신설 2011.7.28>

④ 재외선거관리위원회가 제3항에 따라 개표하는 때에는 선거일 오후 6시 이후에 개표참관인의 참관 아래 공관에서 개표하고, 그 결과를 중앙선거관리위원회에 보고하며, 중앙선거관리위원회는 관할 선거구선거관리위원회에 그 결과를 통지한다. <신설 2011.7.28>

⑤ 제3항에 따라 개표하는 경우 개표참관인 선정ㆍ신고 등에 관하여는 제218조의20제2항부터 제5항까지를 준용한다. 이 경우 "재외투표소별로"는 "개표소별로"로, "투표참관인"은 "개표참관인"으로, "선거일 전 17일"은 "선거일 전 3일"로, "재외투표기간에는 그 재외투표소에서"는 "개표일에는 개표소에서"로 본다. <신설 2011.7.28, 2015.12.24>

⑥ 재외선거관리위원회가 재외투표를 개표하는 경우 재외투표의 보관, 개표의 진행 및 절차, 개표결과의 보고ㆍ통지, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <신설 2011.7.28>
