Public Official Election Act, Article 65 (Election Bulletins)

①후보자(대통령선거에 있어서 정당추천후보자와 비례대표국회의원선거 및 비례대표지방의회의원선거의 경우에는 그 추천정당을 말한다. 이하 이 조에서 같다)는 선거운동을 위하여 책자형 선거공보 1종(대통령선거에서는 전단형 선거공보 1종을 포함한다)을 작성할 수 있다. 이 경우 비례대표국회의원선거 및 비례대표지방의회의원선거에서는 중앙선거관리위원회규칙으로 정하는 바에 따라 해당 정당이 추천한 후보자 모두의 사진ㆍ성명ㆍ학력ㆍ경력을 게재하여야 한다. <개정 2010.1.25, 2012.1.17>

②제1항의 규정에 따른 책자형 선거공보는 대통령선거에 있어서는 16면 이내로, 국회의원선거 및 지방자치단체의 장선거에 있어서는 12면 이내로, 지방의회의원선거에 있어서는 8면 이내로 작성하고, 전단형 선거공보는 1매(양면에 게재할 수 있다)로 작성한다.

③제1항의 규정에 따른 책자형 선거공보의 수량은 당해 선거구 안의 세대수와 예상 거소투표신고인수 및 제5항에 따른 예상 신청자수를 합한 수에 상당하는 수 이내로, 전단형 선거공보의 수량은 당해 선거구 안의 세대수에 상당하는 수 이내로 한다. <개정 2012.2.29, 2014.1.17>

④후보자는 제1항의 규정에 따른 선거공보 외에 시각장애선거인(선거인으로서 「장애인복지법」 제32조에 따라 등록된 시각장애인을 말한다. 이하 이 조에서 같다)을 위한 선거공보(이하 "점자형 선거공보"라 한다) 1종을 제2항에 따른 책자형 선거공보의 면수의 두 배 이내에서 작성할 수 있다. 다만, 대통령선거ㆍ지역구국회의원선거 및 지방자치단체의 장선거의 후보자는 점자형 선거공보를 작성ㆍ제출하여야 하되, 책자형 선거공보에 그 내용이 음성ㆍ점자 등으로 출력되는 인쇄물 접근성 바코드를 표시하는 것으로 대신할 수 있다. <개정 2008.2.29, 2010.1.25, 2015.8.13, 2018.4.6, 2020.12.29>

⑤ 사전투표소에서 투표할 수 있는 선거인 중 법령에 따라 영내 또는 함정에 장기 기거하는 군인이나 경찰공무원은 선거인명부작성기간 중 관할 구ㆍ시ㆍ군선거관리위원회에 자신의 거주지로 책자형 선거공보를 발송해 줄 것을 서면이나 중앙선거관리위원회 홈페이지를 통하여 신청할 수 있다. 이 경우 부대장ㆍ경찰관서의 장은 선거인명부작성기간 개시일 전일까지 소속 군인ㆍ경찰공무원에게 선거공보의 발송 신청을 할 수 있다는 사실을 알려야 한다. <신설 2014.1.17, 2015.8.13>

후보자가 후보자등록마감일 후 6일(제51조에 따른 추가등록의 경우에는 추가등록마감일 후 2일)까지 배부할 지역을 관할하는 구ㆍ시ㆍ군선거관리위원회에 제출하고 당해 선거관리위원회가 이를 확인하여 관할구역 안의 매세대에는 제출마감일 후 3일까지, 제5항에 따른 발송신청자에게는 선거일 전 10일까지 각각 우편으로 발송하고, 거소투표신고인명부에 올라 있는 선거인에게는 제154조에 따라 거소투표용지를 발송하는 때에 동봉하여 발송한다.

후보자가 후보자등록마감일 후 10일까지 배부할 지역을 관할하는 구ㆍ시ㆍ군선거관리위원회에 제출하고 당해 선거관리위원회가 이를 확인하여 제153조(투표안내문의 발송)의 규정에 따른 투표안내문을 발송하는 때에 이를 동봉하여 발송한다. 이 경우 선거인명부 확정결과 책자형 선거공보를 발송하지 아니한 세대가 있는 때에는 그 세대에 이를 전단형 선거공보와 함께 추가로 발송하여야 한다.

2. 국회의원선거, 지방자치단체의 의회의원 및 장의 선거후보자가 후보자등록마감일 후 7일까지 배부할 지역을 관할하는 구ㆍ시ㆍ군선거관리위원회에 제출하고 해당 선거관리위원회가 이를 확인하여 제5항에 따른 발송신청자에게는 선거일 전 10일까지 우편으로 발송하고, 매세대에는 제153조에 따라 투표안내문을 발송하는 때에, 거소투표신고인명부에 올라 있는 선거인에게는 제154조에 따라 거소투표용지를 발송하는 때에 각각 동봉하여 발송한다.

⑦구ㆍ시ㆍ군의 장은 제4항의 규정에 따른 시각장애선거인과 그 세대주의 성명ㆍ주소를 조사하여 선거기간개시일 전 20일까지 관할구ㆍ시ㆍ군선거관리위원회에 통보하여야 한다. <개정 2014.1.17>

⑧대통령선거, 지역구국회의원선거, 지역구지방의회의원선거 및 지방자치단체의 장선거에서 책자형 선거공보(점자형 선거공보를 포함한다)를 제출하는 경우에는 중앙선거관리위원회규칙으로 정하는 바에 따라 다음 각 호에 따른 내용(이하 이 조에서 "후보자정보공개자료"라 한다)을 그 둘째 면에 게재하여야 하며, 후보자정보공개자료에 대하여 소명이 필요한 사항은 그 소명자료를 함께 게재할 수 있다. 이 경우 그 둘째 면에는 후보자정보공개자료와 그 소명자료만을 게재하여야 하며, 점자형 선거공보에 게재하는 후보자정보공개자료의 내용은 책자형 선거공보에 게재하는 내용과 똑같아야 한다. <개정 2006.3.2, 2010.1.25, 2011.7.28, 2014.1.17>
