관세법 제108조(담보 제공 및 사후관리)

① 세관장은 필요하다고 인정될 때에는 대통령령으로 정하는 범위에서 관세청장이 정하는 바에 따라 이 법이나 그 밖의 법령ㆍ조약ㆍ협정 등에 따라 관세를 감면받거나 분할납부를 승인받은 물품에 대하여 그 물품을 수입할 때에 감면받거나 분할납부하는 관세액(제97조제4항 및 제98조제2항에 따른 가산세는 제외한다)에 상당하는 담보를 제공하게 할 수 있다.

② 이 법이나 그 밖의 법률ㆍ조약ㆍ협정 등에 따라 용도세율을 적용(제83조제1항 단서에 해당하는 경우는 제외한다)받거나 관세의 감면 또는 분할납부를 승인받은 자는 대통령령으로 정하는 바에 따라 해당 조건의 이행 여부를 확인(이하 이 조에서 "사후관리"라 한다)하는 데에 필요한 서류를 세관장에게 제출하여야 한다. <개정 2023.12.31>

③ 관세청장은 사후관리를 위하여 필요한 경우에는 대통령령으로 정하는 바에 따라 해당 물품의 사후관리에 관한 업무를 주무부장관에게 위탁할 수 있으며, 주무부장관은 물품의 사후관리를 위하여 필요한 경우에는 미리 관세청장과 협의한 후 위탁받은 사후관리에 관한 업무를 관계 기관이나 법인ㆍ단체 등에 재위임하거나 재위탁할 수 있다. <개정 2019.12.31, 2023.12.31>

④ 용도세율을 적용받거나 관세를 감면받은 물품을 세관장의 승인을 받아 수출한 경우에는 이 법을 적용할 때 용도 외의 사용으로 보지 아니하고 사후관리를 종결한다. 다만, 용도세율을 적용받거나 관세를 감면받은 물품을 가공하거나 수리할 목적으로 수출한 후 다시 수입하거나 해외시험 및 연구를 목적으로 수출한 후 다시 수입하여 제99조제3호 또는 제101조제1항제2호에 따른 감면을 받은 경우에는 사후관리를 계속한다.
