관세법 제235조의2(탁송품 등의 상표권 보호 절차 간소화)
Customs Act, Article 235-2 (Simplified Procedures for Protection of Trademark Rights for Consigned Goods)
세관장은 제235조제3항 각 호의 물품이 다음 각 호의 사유에 모두 해당하는 경우에는 같은 조 제3항부터 제6항까지에도 불구하고 대통령령으로 정하는 바에 따라 담보 제공, 통관의 보류ㆍ허용 및 유치ㆍ유치해제 등에 필요한 사항을 생략하거나 간소한 방법으로 적용할 수 있다.
Where goods under the subparagraphs of Article 235 (3) meet all of the following conditions, the head of a customs office may, notwithstanding paragraphs (3) through (6) of the same Article, omit or apply in a simplified manner the matters necessary for the provision of security, withholding and permission of customs clearance, detention and release from detention, and the like, as prescribed by Presidential Decree:
1. 제235조제1항제1호에 따른 상표권을 침해하였다고 인정되는 경우
1. Where the goods are found to infringe trademark rights under Article 235 (1) 1;
2. 탁송품 또는 우편물로서 관세청장이 정하는 가격 이하의 물품인 경우
2. Where the goods are consigned goods or postal items valued at or below the price determined by the Commissioner of the Korea Customs Service.
