관세법 제327조의2(한국관세정보원의 설립)

① 정부는 관세정보시스템을 안정적으로 운영ㆍ관리하고, 관세정보시스템의 지능정보화를 촉진하여 통상환경을 개선함으로써 국민경제의 발전에 이바지하기 위하여 한국관세정보원(이하 "관세정보원"이라 한다)을 설립한다.

(1) The^ð더 Government거^v버먼트 shall섈 establish이스태블리시 the^ð더 Korea코^r리아 Customs커스텀즈 Information인^f퍼메이션 Service서^v비스 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "Customs커스텀즈 Information인^f퍼메이션 Service")서^v비스 to투 contribute컨트^r리븃 to투 the^ð더 development디^v벨럽먼트 of어^v브 the^ð더 national내셔늘 economy이카너미 by바이 stably스테이블리 operating아퍼^r레이팅 and앤드 managing매너징 the^ð더 customs커스텀즈 information인^f퍼메이션 system시스텀 and앤드 improving임프^r루^v빙 the^ð더 trade트^r레이드 environment인^v바이^r런먼트 through^θ쓰^r루 promoting프^r러모우팅 intelligent인텔러전트 informatization인^f포머티제이션 of어^v브 the^ð더 customs커스텀즈 information인^f퍼메이션 system.시스텀

② 관세정보원은 법인으로 한다.

(2) The^ð더 Customs커스텀즈 Information인^f퍼메이션 Service서^v비스 shall섈 be비 a어 corporation.코퍼^r레이션

③ 관세정보원은 그 주된 사무소의 소재지에 설립등기를 함으로써 성립한다.

(3) The^ð더 Customs커스텀즈 Information인^f퍼메이션 Service서^v비스 shall섈 be비 formed^f폼드 by바이 registering^r레지스터^r링 its잇츠 establishment이스태블리시먼트 at앳 the^ð더 location로케이션 of어^v브 its잇츠 principal프^r린서플 office.오^f피스

④ 관세정보원의 정관에는 다음 각 호의 사항이 포함되어야 하며, 정관을 변경할 때에는 관세청장의 인가를 받아야 한다.

(4) The^ð디 articles아터클즈 of어^v브 incorporation인코퍼^r레이션 of어^v브 the^ð더 Customs커스텀즈 Information인^f퍼메이션 Service서^v비스 shall섈 include인클루드 the^ð더 following^f팔로잉 matters,매터즈 and앤드 any에니 amendment어멘드먼트 to투 the^ð디 articles아터클즈 of어^v브 incorporation인코퍼^r레이션 shall섈 be비 subject서브젝트 to투 authorization오^θ써^r러제이션 by바이 the^ð더 Commissioner커미셔너 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service:서^v비스

⑤ 관세정보원은 다음 각 호의 사업을 한다.

(5) The^ð더 Customs커스텀즈 Information인^f퍼메이션 Service서^v비스 shall섈 carry캐^r리 out아웃 the^ð더 following^f팔로잉 projects:프^r라젝츠

⑥ 관세정보원장은 정관으로 정하는 바에 따라 관세청장이 임명한다.

(6) The^ð더 head헤드 of어^v브 the^ð더 Customs커스텀즈 Information인^f퍼메이션 Service서^v비스 shall섈 be비 appointed어포인티드 by바이 the^ð더 Commissioner커미셔너 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service,서^v비스 as애즈 prescribed프^r리스크^r라이브드 by바이 the^ð디 articles아터클즈 of어^v브 incorporation.인코퍼^r레이션

⑦ 관세정보원은 관세청장의 승인을 받아 제5항에 따른 사업 외에 설립목적 달성에 필요한 경비를 조달하기 위하여 수익사업을 할 수 있다.

(7) With위^ð드 the^ð디 approval어프^r루^v블 of어^v브 the^ð더 Commissioner커미셔너 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service,서^v비스 the^ð더 Customs커스텀즈 Information인^f퍼메이션 Service서^v비스 may,메이 in인 addition어디션 to투 the^ð더 projects프^r라젝츠 under언더 paragraph패^r러그^r래^f프 (5), carry캐^r리 out아웃 profit-making프^r라^f핏-메이킹 projects프^r라젝츠 to투 raise^r레이즈 funds^f펀즈 necessary네서세^r리 to투 achieve어치^v브 the^ð더 purpose퍼퍼스 of어^v브 its잇츠 establishment.이스태블리시먼트

⑧ 정부는 관세정보원의 시설, 운영 및 사업에 필요한 경비를 예산의 범위에서 출연하거나 보조할 수 있다.

(8) The^ð더 Government거^v버먼트 may메이 contribute컨트^r리븃 or오 subsidize,서브시다이즈 within위^ð딘 the^ð더 limits리멋츠 of어^v브 the^ð더 budget,버짓 the^ð디 expenses익스펜시즈 necessary네서세^r리 for^f포 the^ð더 facilities,^f퍼실러티즈 operation아퍼^r레이션 and앤드 projects프^r라젝츠 of어^v브 the^ð더 Customs커스텀즈 Information인^f퍼메이션 Service.서^v비스

⑨ 관세정보원에 대하여 이 법과 「공공기관의 운영에 관한 법률」에서 규정한 것 외에는 「민법」 중 재단법인에 관한 규정을 준용한다.

⑩ 이 법에 따른 관세정보원이 아닌 자는 한국관세정보원 또는 이와 유사한 명칭을 사용하지 못한다.

⑪ 관세청장은 관세정보원의 업무를 지도ㆍ감독한다.

(11) The^ð더 Commissioner커미셔너 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service서^v비스 shall섈 guide가이드 and앤드 supervise수퍼^v바이즈 the^ð더 work워크 of어^v브 the^ð더 Customs커스텀즈 Information인^f퍼메이션 Service.서^v비스

⑫ 관세청장은 필요하면 소속 공무원에게 관세정보원의 업무ㆍ회계 및 재산에 관한 사항을 검사하게 하거나 관세정보원에 대하여 필요한 자료의 제출을 요구할 수 있다. <신설 2024.12.31>

⑬ 관세청장은 제12항에 따라 검사를 한 결과 위법하거나 부당한 사항이 있는 경우에는 관세정보원에 그 시정을 명하거나 그 밖에 필요한 조치를 할 수 있다. <신설 2024.12.31>
