국가배상법 시행령 제18조(배상원인의 발생과 필요한 조사)

①배상신청을 받은 심의회의 위원장 또는 위원장의 명을 받은 자는 배상결정에 필요한 조사를 할 수 있고 관계기관에 사실을 조회하거나 필요한 자료의 제출을 요청할 수 있다. <개정 1998.2.19>

②배상신청을 받은 심의회의 위원장 또는 위원장의 명을 받은 자는 가해공무원(군인ㆍ군무원을 포함한다)이 소속하는 기관(군부대를 포함한다)의 장에게 배상의 원인이 되는 사실발생에 관한 조회를 하여 그 확인을 받아야 하고 조회를 받은 기관의 장은 그 사실을 확인한 후 문서로 회보하여야 한다. <개정 1998.2.19>

③제1항의 조사를 함에 있어서는 당해 사건과 관련된 기관이나 다른 법령에 의하여 당해 사건을 수사하는 공무원 또는 그 기관의 장에게 필요한 협조를 요청할 수 있다.

④제1항 또는 제3항의 요청을 받은 공무원이나 관계기관의 장은 정당한 사유없이 이에 응하지 아니하거나 회보를 지체하여서는 아니된다.

⑤제1항 내지 제4항의 규정은 국가 또는 지방자치단체를 위하여 국가배상청구소송을 수행하는 자가 소송수행에 필요한 자료를 조사하는 경우에 이를 준용한다.
