국민건강보험법 제89조(건강보험분쟁조정위원회)

① 제88조에 따른 심판청구를 심리ㆍ의결하기 위하여 보건복지부에 건강보험분쟁조정위원회(이하 "분쟁조정위원회"라 한다)를 둔다.

(1) A어 Health헬^θ스 Insurance인슈^r런스 Dispute디스퓻 Mediation미디에이션 Committee커미티 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "Dispute디스퓻 Mediation미디에이션 Committee")커미티 shall섈 be비 established이스태블리시트 in인 the^ð더 Ministry미너스트^r리 of어^v브 Health헬^θ스 and앤드 Welfare웰^f페어 to투 examine이그재민 and앤드 decide디사이드 on안 requests^r리퀘스츠 for^f포 adjudication어주더케이션 under언더 Article아터클 88.

② 분쟁조정위원회는 위원장을 포함하여 60명 이내의 위원으로 구성하고, 위원장을 제외한 위원 중 1명은 당연직위원으로 한다. 이 경우 공무원이 아닌 위원이 전체 위원의 과반수가 되도록 하여야 한다. <개정 2014.1.1, 2018.12.11>

③ 분쟁조정위원회의 회의는 위원장, 당연직위원 및 위원장이 매 회의마다 지정하는 7명의 위원을 포함하여 총 9명으로 구성하되, 공무원이 아닌 위원이 과반수가 되도록 하여야 한다. <개정 2018.12.11>

④ 분쟁조정위원회는 제3항에 따른 구성원 과반수의 출석과 출석위원 과반수의 찬성으로 의결한다.

(4) The^ð더 Dispute디스퓻 Mediation미디에이션 Committee커미티 shall섈 make메이크 decisions디시전즈 with위^ð드 the^ð디 attendance어텐든스 of어^v브 a어 majority머조^r러티 of어^v브 the^ð더 members멤버즈 under언더 paragraph패^r러그^r래^f프 (3) and앤드 the^ð디 approval어프^r루^v블 of어^v브 a어 majority머조^r러티 of어^v브 the^ð더 members멤버즈 present.프^r레전트

⑤ 분쟁조정위원회를 실무적으로 지원하기 위하여 분쟁조정위원회에 사무국을 둔다. <신설 2014.1.1>

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 분쟁조정위원회 및 사무국의 구성 및 운영 등에 필요한 사항은 대통령령으로 정한다. <개정 2014.1.1>

⑦ 분쟁조정위원회의 위원 중 공무원이 아닌 사람은 「형법」 제129조부터 제132조까지의 규정을 적용할 때 공무원으로 본다. <신설 2016.2.3>
