국민기초생활 보장법 시행령 제40조(보조금의 정산)

① 지방자치단체는 지출한 보장비용의 총액이 법 제43조제2항 또는 제3항에 따라 국가(시ㆍ군ㆍ구의 경우에는 시ㆍ도를 말한다. 이하 이 조에서 같다)에서 받은 보조금과 법 제43조제1항제4호의 비율에 따른 해당 지방자치단체 부담금의 합계액을 초과하는 경우에는 그 초과 지출한 금액에 대하여 법 제43조제1항제4호의 비율에 따른 보조금을 국가에 신청할 수 있다.

② 지방자치단체는 지출한 보장비용의 총액과 법 제43조제2항 또는 제3항에 따라 국가에서 받은 보조금 및 해당 지방자치단체 부담금의 합계액을 정산한 결과 잉여금이 있는 경우에는 그 잉여금에서 법 제43조제1항제4호의 비율에 따른 해당 지방자치단체의 부담금을 빼고 남은 잉여금은 국가에 반납하여야 한다.
