국민기초생활 보장법 제18조의11(개인정보의 보호)

① 보건복지부장관은 제18조의10제4항에 따른 수행기관의 통합정보전산망 사용 요청에 대하여 같은 조 제2항 각 호의 정보 중 업무에 필요한 최소한의 정보만 제공하여야 한다. <개정 2021.7.27>

② 수행기관은 제18조의10제4항에 따라 보건복지부장관에게 통합정보전산망 사용을 요청하는 경우 보안교육 등 자활지원사업 참여자의 개인정보에 대한 보호대책을 마련하여야 한다. <개정 2021.7.27>

③ 수행기관은 제18조의10제2항부터 제4항까지에 따른 자료 및 관계 전산망을 이용하고자 하는 경우에는 사전에 정보주체의 동의를 받아야 한다. <개정 2021.7.27>

④ 수행기관은 제18조의10제2항부터 제4항까지에 따른 자료 및 관계 전산망을 이용함에 있어 다음 각 호의 개인정보를 제외한 정보는 참여자의 수급이력 및 근로활동현황 등 자활지원사업의 수행ㆍ관리 및 효과분석 목적을 달성한 경우 지체 없이 파기하여야 한다. <개정 2021.7.27>

⑤ 제18조의10제2항 각 호의 개인정보는 수행기관에서 자활지원사업을 담당하는 자 중 해당 기관의 장으로부터 개인정보 취급승인을 받은 자만 취급할 수 있다. <개정 2021.7.27>

⑥ 자활지원사업 업무에 종사하거나 종사하였던 자는 자활지원사업 업무 수행과 관련하여 알게 된 개인ㆍ법인 또는 단체의 정보를 누설하거나 다른 용도로 사용해서는 아니 된다.
