국민투표법 제104조(투표함 등에 관한 죄)

① 법령에 따르지 아니하고 투표함을 열거나 투표함(빈 투표함을 포함한다)이나 투표함 안의 투표지를 가져가거나 파괴ㆍ훼손하거나 숨기거나 빼앗은 사람은 1년 이상 10년 이하의 징역에 처한다.

② 검사ㆍ경찰공무원(사법경찰관리를 포함한다) 또는 군인(군수사기관소속 군무원을 포함한다)이 제1항에 규정된 행위를 하거나 하게 한 때에는 2년 이상 10년 이하의 징역에 처한다.
